Obama taking more steps on own to help businesses (AP)

WASHINGTON ? Pushing a campaign to act without Congress, President Barack Obama will announce on Friday two more executive actions on the economy, both of them small steps intended to give a boost to businesses.

The moves cap a week in which Obama has sought to employ the power of his office as he struggles to make headway on his jobs bill on Capitol Hill.

Obama is directing government agencies to shorten the time it takes for federal research to turn into commercial products in the marketplace. The goal is to help startup companies and small businesses create jobs and expand their operations more quickly.

On the other front, Obama is calling for creation of a centralized online site, to be known as BusinessUSA, for companies to easily find information on federal services. The site is to be up and running within 90 days and will be designed with input from U.S. businesses.

Obama is announcing both steps in presidential memos to be released Friday morning, according to administration officials.

On a larger scale, the president himself announced two other executive actions this week, one offering help for homeowners seeking to refinance at lower mortgage rates and the other allowing college students to simplify and lower their student loan payments. The White House also issued a challenge to community health centers in a bid to help get veterans jobs.

White House aides expect more such actions in coming days. Obama, up for re-election, is waging a public campaign to show voters he is acting on jobs more than Republicans are.

The Republicans who control the House counter that their economic bills have not been considered in the Senate. And they question Obama's latest tactic.

"This idea that you're just going to go around the Congress is just, it's almost laughable," House Speaker John Boehner told radio talk show host Laura Ingraham on Thursday.

Cain momentum continues; South could be key

HOMEWOOD, Ala. (AP) ? Herman Cain's rise in the polls appears to be no fluke.

Unlike some other Republican presidential contenders who have flamed out fast after auditioning as the conservative antidote to Mitt Romney, Cain is still riding high atop public opinion surveys.

"They said I was the flavor of the week," the Georgia businessman said at an appearance Friday on a campaign swing through Alabama. "But four weeks later the Cain campaign still tastes good!"

Cain lacks the money and organization of his top-tier GOP competitors. But, so far, he's survived several high-profile campaign blunders and an onslaught of attacks on his signature 9-9-9 tax overhaul plan.

And despite the sudden rise to the top tier of the GOP, Cain is still doing things his own way.

He's carving out an unorthodox ? and some say impossible ? path to the White House, largely eschewing early voting states to focus heavily on the South ? where tea party groups, social conservatives and evangelical voters that make up the backbone of his support hold sway. It's been weeks since Cain has set foot in Iowa or New Hampshire. Instead, he's barnstormed through Tennessee and Alabama, states that don't hold primaries until March.

"The South looks very, very good for us," Mark Block, Cain's campaign manager, said in an interview with The Associated Press. "Do the early states matter? Of course. But they are not everything."

Block argues that next year's compressed primary calendar means more states will play larger roles. So instead of tromping around New Hampshire trying to win over skeptics, the campaign team is revving up support in states where Cain's small government, anti-tax message and church revival-style delivery resonate with voters.

Cain was trying to show that in Alabama, which won't hold its primary until March 13, and where he was greeted with enthusiastic overflow crowds at every stop. In Talladega, residents were visibly excited by the first visit from a presidential candidate in modern memory.

"I heard that FDR waved from the train once when he came through," said Jeanne Rasco, who had turned out for a packed Cain rally at a historic theater on the city square.

"I think it shows he cares about our values. He's one of us," she said.

Cain himself plays up his Southern roots: His drawl grows a little thicker and he mentions God a little more frequently, to suit the crowd.

"I am in Alabama because Alabama matters," Cain said at the state's party headquarters. "Ya'll are my neighbors."

And in the South, some Cain supporters say that supporting an African-American could turn long-held racial perceptions around. No Deep South states supported Barack Obama in 2008 and elected representatives in the state have become more racially polarized in recent years.

Scott Beason, a Republican Alabama state senator, said a Cain win, especially in the Deep South, would be a visible sign of progress.

"It would change the stereotypes that still exist about how people make their decisions down here," Beason said. "I think it's ironic that he will do better here than in the so-called enlightened states up north."

"What folks are doing is listening to what is he saying and he is not afraid to say what he thinks."

But is the Cain bubble going to burst?

Cain himself says no and mocks rumors that he's simply in the race to promote his brand.

"I've written some books," he said. "I don't want no TV show."

Giants fan's lawyer criticizes Dodgers attorney

(AP) ? An attorney for San Francisco Giants fan Bryan Stow has responded to comments made by a lawyer for the Los Angeles Dodgers who suggested Stow might be partly to blame for a brutal attack he received in a Dodger Stadium parking lot on opening day.

Thomas Girardi told the Los Angeles Times (http://tinyurl.com/3vrtusb ) on Friday it was wrong for attorney Jerome Jackson to say Stow may have to share some of the blame for the attack.

Jackson told ESPNLosAngeles.com that the Dodgers and their owner Frank McCourt shouldn't be held fully liable by a possible jury. The Stow family filed a lawsuit blaming the Dodgers organization and owner Frank McCourt for the attack.

Jackson filed a cross-complaint last week saying two men charged with beating Stow should be held liable.

Google paid $151M for Zagat in flurry of 3Q deals (AP)

SAN FRANCISCO ? Google spent more than $500 million to acquire another 27 companies during the third quarter, ensuring this year will be busiest shopping spree in the Internet search leader's history.

The tally emerged Wednesday in a quarterly report that included another previously undisclosed nugget: Google Inc. paid $151 million in cash for the Zagat Survey, a renowned restaurant review publisher that Google bought to counter the popularity of Yelp's business rating service. The price is higher than estimated in previously published reports, which pegged the deal's value between $65 million and $125 million.

Google's latest flurry of deals raised its acquisition count to 57 companies through the first nine months of the year. That already exceeds Google's previous annual record of 48 acquisitions, reached last year.

Although Google has never completed more acquisitions in its 13-year history, the company isn't guaranteed of setting a new spending record.

Through September, Google's deals had cost a total of $1.4 billion. That's below the $1.8 billion that Google spent last year and less than the $3.2 billion it spent in 2008 buying online advertising service DoubleClick, its biggest-ever purchase and its only acquisition that year.

Google agreed to buy cell phone maker for Motorola Mobility Inc. for $12.5 billion in August, but that deal may not be completed before the end of the year. That's because the U.S. Justice Department is investigating whether the proposed takeover would stifle competition in the increasingly important mobile phone market.

Most of Google's acquisitions involve small startups that are developing promising technology or employ talented engineers.

Google snapped up the Zagat Survey because it wanted a well-known brand that would allow it to feature more restaurant recommendations and reviews on its own website instead of sending Web surfers to Yelp and other rivals.

Google tried to buy Yelp in 2009, only to be rebuffed. Yelp is now among a group of competitors trying to convince U.S. regulators that Google has abused its dominance of Internet search by highlighting its own services in its results.

After Zagat, the next-largest acquisition Google completed in the third quarter was the $114 million purchase of Daily Deals, an online discount service in Europe.

Atlanta police arrest Wall Street protesters (AP)

ATLANTA ? Helicopters hovered, shining spotlights on a downtown Atlanta park where police arrested more than 50 Occupy Wall Street protesters who had set up an encampment for about two weeks.

Streets were barricaded around Woodruff Park where ? like in many American cities ? protesters had camped out to rally against what they see as corporate greed and a wide range of other economic issues. Before police marched in, protesters were warned a couple times around midnight to vacate the park or risk arrest.

Organizers had instructed participants to be peaceful if arrests came, and most were, though police did drag out a few. Many gathered in the center of the park, locking arms, and sang "We Shall Overcome," until police led them out, one-by-one to waiting buses. Most left on foot, handcuffed with plastic ties.

Police included SWAT teams in riot gear, dozens of officers on motorcycles and several on horseback. By about 1:30 a.m. the park was mostly cleared of protesters.

"It's real simple: This is a crisis of priorities that this small group of campers ... is the greatest threat in this city. It's outrageous," said organizer Tim Franzen.

Mayor Kasim Reed on Monday said he planned to revoke the permit allowing Occupy Atlanta protesters to live in the park, but was vague about when that might come.

Late Tuesday, police started surrounding the park at a busy intersection, and some protesters gathered up their tents, pillows, sleeping bags and other belongings, saying they didn't want to lose them. Right after the order to leave, some did, standing outside the barricades.

Hundreds of others stood on Atlanta's famous Peachtree Street, booing police. They shouted "Shame!" and "Who do you protect? Who do you serve?"

Reed said he was upset over an advertised hip-hop concert that he said drew 600 people to the park over the weekend but didn't have a permit and didn't have security guards to work the crowd, calling it irresponsible. Members of Reed's staff were at the scene of the arrests and many said the mayor had also arrived and might give a statement.

As police moved in, protesters chanted, "Who's park, our park," and "We are here, we are stronger, we can't take it any longer."

TV images showed the number of police far outnumbering the protesters.

The arrests in Atlanta appeared peaceful. In Oakland, Calif., police shot tear gas in response to rock throwing from some of the demonstrators who had gathered there, authorities said.

Gloria Tatum, 68, watched the arrests from behind the barricades and said, "This is a real movement."

The Asian Development Oct. 25 announced?a new Communications Policy, revising its rules on disclosure and adding an appeals body.

According to the Bank, the key changes include:

  • earlier disclosure of core ADB documents, such as final proposals for country partnership strategies and sovereign project loans, subject to country consent.
  • translation of summary project information into relevant national languages.
  • release of project financial statements of borrowers for ADB-financed sovereign projects.
  • strengthening of in-country communications to give the public more information about projects and other ADB activities that could affect their lives.
  • disclosure of proposed policies and strategies that have been drawn up after public consultation, prior to Board consideration.
  • clarification of the disclosure exceptions list, with inclusion of harm-test.
  • creation of an independent appeals panel with three international experts to review information requests denied by ADB.
  • increased dissemination of knowledge products?online and in hard copy?to support the development of knowledge-based economies in the region.
  • disclosure of transcripts of ADB Board meetings upon request after 10 years.

?The revised policy also strengthens ADB?s communications and engagement with affected people, including women, the poor, and other vulnerable groups, and recognizes that more traditional methods of communication must be applied to reach large groups of stakeholders who do not have access to technology,? according to the ADB.

The changes to the previous policy, from 2005, follow a consultation period in which the Bank said it got feedback from over 500 stakeholders.

The Bills have paid linebacker Shawne Merriman $6.95 million over the last season and a half?for one sack and nine tackles in five games.

Amazingly, Merriman?s contract appears to get worse for the Bills.

According to a January article by Tim Graham (formerly of ESPN.com), Merriman is guaranteed another $3 million in 2012. ?We?ve seen it written that the Bills had some injury protection for that money, but that no longer appears to be true.

Graham wrote that Merriman?s 2012 money was guaranteed the moment he was cleared to practice this year.?In essence, his new Achilles injury is viewed as different problem than his old Achilles injury. ?So the Bills are on the hook for it.

Merriman is due $4 million in base salary in 2012 and a $1 million roster bonus next March. ?We can?t imagine the Bills will give him another chance, so they will basically have to pay him $3 million to go away.

Claiming and then signing Merriman never made any sense. I?ve heard from Bills fans that they had to take a roll of the dice to get some talent. That?s insane. ?The Bills have done so many things right in the Gailey/Nix era, but there is no defending the Merriman contract.

It was a terrible bet the moment the contract was signed. Merriman missed 30 games between 2008-2010, including 13 last year. He has 4 sacks since 2007. ?He was never going to make big money on the open market. ?Guaranteed base salaries are for star players; Merriman was not in that kind of bargaining position.

If the Bills wanted to take a risk on Merriman, they could have waited for him to be a free agent and given him something like a 1-year, $3 million contract. That?s more money than far more productive linebackers got after the lockout.

Instead, the Bills will wind up paying almost $10 million to Merriman for one sack. That apparently includes $3 million next year, when he may no longer even be in the NFL.

Presidential hopeful Cain ups fundraising total (Reuters)

WASHINGTON (Reuters) ? Businessman Herman Cain, rising in national polls, raised $2.8 million in the third quarter to finance his run for the 2012 Republican presidential nomination, far shy of his main rivals but an increase over his earlier fundraising efforts, his campaign said on Saturday.

Cain, a former CEO of Godfather's Pizza who has never held elective office, raised an additional $2 million after the reporting period ended on September 30, his campaign said. His campaign also reported $1.33 million cash on hand and no debt.

He entered the race as a long-shot but has picked up momentum in recent weeks, winning the September 24 Florida straw poll -- a test of strength of the Republican candidates -- and gaining news media coverage for his tax reform proposals.

Cain placed first in an NBC-Wall Street Journal poll among Republican candidates and second in a Reuters Ipsos poll this week.

His fundraising totals in the third quarter were far behind Texas Governor Rick Perry's $17 million and former Massachusetts Governor Mitt Romney's $14 million.

Cain had raised $2 million in the second quarter, among the lowest of the major Republican presidential aspirants.

"Mr. Cain's message is spreading and attracting supporters all across the country," Mark Block, Chief Operating Officer for Friends of Herman Cain Inc., said in a statement.

Cain's signature "9-9-9" tax proposal would create a flat 9 percent income, corporate and national sales tax rate.

His supporters, including Republicans aligned with the conservative Tea Party movement, support the plan for its commitment to lower taxes. Critics say the plan would benefit wealthy taxpayers at the expense of middle- and lower-income Americans.

In another development, former Utah Governor Jon Huntsman's campaign reported having about $327,000 in cash on hand at the end of the third quarter, raising questions about his long-term viability in his long-shot run for the Republican nomination.

Huntsman, who served as U.S. ambassador to China under President Barack Obama before entering the race, has lent himself $2.24 million so far in his bid for the nomination.

One in six mobile phones in Britain is contaminated with faecal matter, according to new research released ahead of Global Handwashing Day.

Experts say the most likely reason for the potentially harmful bacteria festering on so many gadgets is people failing to wash their hands properly with soap after going to the toilet.

The findings of the UK-wide study by scientists from the London School of Hygiene & Tropical Medicine and Queen Mary, University of London also reveal a tendency among Britons to lie about their hygiene habits.

Although 95% of people said they washed their hands with soap where possible, 92% of phones and 82% of hands had bacteria on them. Worryingly, 16% of hands and 16% of phones were found to harbour E. coli ? bacteria of a faecal origin. Harmful E. coli (Escherichia coli) is associated with stomach upsets and has been implicated in serious cases of food poisoning such as the fatal O157 outbreak in Germany in June.

Hygiene expert and UK campaign leader for Global Handwashing Day Dr Val Curtis, from the London School of Hygiene & Tropical Medicine, said: "This study provides more evidence that some people still don't wash their hands properly, especially after going to the toilet. I hope the thought of having E. coli on their hands and phones encourages them to take more care in the bathroom ? washing your hands with soap is such a simple thing to do but there is no doubt it saves lives."

Peter Barratt, Technical Manager at Initial Washroom Solutions, which supports Global Handwashing Day, said: "Today's research is shocking and demonstrates the importance of effective hygiene. It is critical that people take hand hygiene seriously and that businesses offer their employees and customers a practical way of protecting themselves to help combat the spread of illness."

Researchers travelled to 12 cities and took 390 samples from mobile phones and hands which were analysed in the lab to find out the type and number of germs lurking there. They also asked participants a series of questions about their handwashing habits.

The largest proportion of contaminated phones was in Birmingham (41%) while Londoners were caught with the highest proportion of E. coli present on hands (28%). However, actual levels of bacteria increased the further north the scientists went, the dirtiest city being Glasgow, where average bacterial levels on phones and hands were found to be nine times higher than in Brighton, reinforcing a North/South divide. The scientists also found those who had bacteria on their hands were three times as likely to have bacteria on their phone.

Dr Ron Cutler, of Queen Mary, University of London, said: "Our analysis revealed some interesting results from around the UK. While some cities did much better than others, the fact that E. coli was present on phones and hands in every location shows this is a nationwide problem. People may claim they wash their hands regularly but the science shows otherwise."

Faecal bacteria can survive on hands and surfaces for hours at a time, especially in warmer temperatures away from sunlight; it is easily transferred by touch to door handles, food and even mobile phones. From there, the germs can be picked up by other people. Every year, 3.5m children under the age of five are killed by pneumonia and diarrhoeal diseases ? and the simple action of washing hands with soap is one of the most effective ways of preventing these illnesses. In developed countries, handwashing with soap helps to prevent the spread of viral infections, such as norovirus, rotavirus and influenza.

Global Handwashing Day - which is held on October 15 every year - aims to transform the action of washing hands with soap into an automatic behaviour, deeply set in our daily lives. Initiatives and events to promote the practice in homes, schools, workplaces and communities are held worldwide.

The UK Global Handwashing coalition involves GlaxoSmithKline, Initial Washroom Solutions, London School of Hygiene & Tropical Medicine, Sanofi Pasteur MSD, School Councils UK, Queen Mary, University of London, The Ideas Foundation and Wellcome Trust.

Radiation hotspot in Tokyo linked to mystery bottles

TOKYO (Reuters) - A radiation hotspot has been detected in Tokyo seven months into Japan's nuclear crisis, but local officials said on Thursday high readings appeared to be coming from mystery bottles stored under a house, not the tsunami-crippled Fukushima atomic plant.

The Fukushima Daiichi nuclear power plant, struck by a devastating quake and tsunami in March, has released radiation into the atmosphere that has been carried by winds, rain and snow across eastern Japan.

Officials in Setagaya, a major residential area in Tokyo about 235 km (150 miles) southwest of the plant, said this week it found a radioactive hotspot on a sidewalk near schools, prompting concerns in the country's most populated area far from the damaged nuclear plant.

The radiation measured as much as 3.35 microsieverts per hour on Thursday, higher than some areas in the evacuation zone near the Fukushima plant, the center of the world's worst nuclear disaster since Chernobyl 25 years ago.

But the local government found several bottles under the floor of a nearby house emitting high levels of radiation.

"A measuring device, when pointed at them, showed very high readings. Radiation levels were even exceeding the upper limit for the device," Setagaya Mayor Nobuto Hosaka told a news conference.

Officials from the Education Ministry are now looking into the matter, including the contents of the bottles.

Public broadcaster NHK said no one had been living in the house in question.

The city of Funabashi, near Tokyo, said that a citizens' group had measured a radiation level of 5.8 microsieverts per hour at a park, but that the city's own survey showed the highest reading at the park was a quarter of that level.

Radiation levels in the 20 km radius evacuation zone around the Fukushima Daiichi plant ranged from 0.5 to 64.8 microsieverts per hour, government data showed this week.

About 80,000 residents have evacuated this zone. A microsievert quantifies the amount of radiation absorbed by human tissue.

In Yokohama, also near Tokyo, radioactive strontium-90, which can cause bone cancer and leukemia, was detected in soil taken from an apartment rooftop, media reported.

Strontium has been detected within an 80 km zone around the Fukushima Daiichi plant, but this is the first time it has been found in an area so far away, local media added.

Radiation exposure from natural sources in a year is about 2,400 microsieverts on average, the U.N. atomic watchdog says.

Japan's education ministry has set a standard allowing up to 1 microsievert per hour of radiation in schools while aiming to bring it down to about 0.11 microsievert per hour.

Social media has blown on to the scene the last couple of years with the popular websites of Facebook, Linkedin, Twitter and many others.

Nobody can tell for sure what social media will look like five years from now, but what everyone can agree upon is that the concept of using the internet to socially communicate is not going away.

For salespeople, an important question is,

?Can social media help in negotiating??

My answer is, ?Yes, it can.?? I?m not saying you should directly negotiate with another person by way of a social media (although I suppose there might be exceptions where this is possible).? What I am saying is that social media is a perfect tool that someone can use to help frame a situation or build their on-line reputation before the negotiations even begin.

Negotiations are won or lost in two critical areas.? The first is the period of time leading up to the start of the negotiations, when both parties are preparing to negotiate. The second is at the end, when the two parties are working out the details of the negotiation.

With regard to social media, I am not an advocate of conducting business negotiations in public.? The reason I feel this way is because it is important throughout the negotiation process to maintain respect and integrity for everyone involved. This can be very hard to ensure if stuff is being thrown around for others to read and see. This is the reason I say the best use of social media in negotiations is before the negotiations even begin.

Using social media before negotiations begin allows you to establish the context of who you are and what your expected outcome might be.? Best example of this is Donald Trump.? He uses social media tools and the media in general to let everyone know who and what he is.

Trump?s goal is to make his brand known, and his brand really is himself.? He wants his brand to appear favorable. He does this by coming across as a shrewd businessperson, and he uses social media to further this persona.? On the one hand, this gives him an upper hand in any negotiations. On the other hand it also alerts everyone who might be planning to do business with him that he most likely is going to be very tough.

Conversely, a person who has used social media to cast a tough but fair image is billionaire investor Warren Buffett.? The image he has crafted in social media and the media in general is one of a very smart long-term investor known for making quick deals based on how he sees a situation. ?The result of this image is many people might be far more willing to enter into negotiations with Warren Buffett under the belief they would be treated more fairly than if they were negotiating with Donald Trump.

The examples I use are extremes, but you see the picture.? This is why I am a very strong believer that anyone who is planning to do any amount of negotiating with others needs to make sure their internet image is the one they want.

Use social media sites to position you and your company in the manner you want to be seen by others.? Be active in how you do this. If you?re not active yourself, other people may craft an image of you that is not accurate.

If you are about to enter into negotiations with another party over a business contract or anything else for that matter, the other party likely will ?Google? your name or company to see what they can learn about you. ?(This is a very common practice).

The other party is going to read all they can about you, and what they read may impact how they choose to negotiate with you.

Some people may like to believe that social media does not have a place in the professional business world.? Sorry, but that is old-school thinking (or maybe I should say, ?That is so 2009 thinking!?)? Today, search engines capture everything, and people expect to find out everything.? When someone can?t find something on the web, they become that much more suspicious.

Finally, don?t think for a moment the web is going to become any less powerful in the years to come.? Just the opposite is true.? It?s going to become more powerful. ?The sooner you accept the reality that you need a solid social media strategy, the better.? The strategy of what you post, how you position yourself and so forth is up to you.? Choose wisely and be consistent.

Always remember that the respect you show to others and the integrity you live by are priceless.? If you build your social media strategy around respect and integrity, you?ll be well on your way to positioning yourself properly for today and tomorrow.

(AP) ? From the beginning, it was a case of contradictions, and the questions did not end with the verdict that freed Amanda Knox.

The acquittal of the American and her ex-boyfriend in the murder of her British roommate left open the core mystery of whether anyone ? other than the lone man still behind bars ? took part in the brutal killing.

But it also begged questions that stretch back to the early days of the investigation into the 2007 death of Meredith Kercher.

Why did Knox initially tell prosecutors she was in the apartment that night and had to cover her ears to drown out her friend's screams as she was brutally attacked by a man Knox falsely accused?

There was also a purported burglary at the apartment that night ? staged, prosecutors alleged, by the killers to derail the investigation. Who staged it and why?

And then there was the alibi of Knox's ex-boyfriend, Raffaele Sollecito, whose conviction was also overturned Monday. He claimed he was at home working on his computer the night of Nov. 1, 2007, yet police testified there was no sign he had used it that evening.

Monday's verdict, reversing Knox and Sollecito's 2009 murder convictions, didn't answer any of those questions. And it's unlikely the appeals court's written explanation of its decision ? due within 90 days ? will shed much light, likely rendering the sensational case a mystery for years to come.

On the core question of who killed Kercher, there may yet be further legal wrangling.

A third defendant, Rudy Hermann Guede of the Ivory Coast, was convicted in a separate trial of sexually assaulting and stabbing Kercher, and his 16-year prison sentence ? reduced on appeal from an initial 30 years ? was upheld by Italy's highest court in 2010.

Guede, a small-time drug dealer who fled Italy after the killing and was extradited from Germany to face the charges, acknowledged he was in Kercher's room the night she died but said he didn't kill her. Guede said he believed Knox and Sollecito did, but offered no evidence to back up his claim.

The high court ruling upholding his sentence said Guede didn't act alone, though it didn't name Knox or Sollecito as his accomplices.

"The courts agree he wasn't acting alone," the victim's brother, Lyle Kercher, told a news conference Tuesday. "If those two are not the guilty parties, then who are the guilty people?"

Guede's lawyer Valter Biscotti told The Associated Press he would seek to reopen the case for his client in light of the acquittals of Knox and Sollecito. He refused any further comment.

During his appeals trial, Guede claimed he heard Kercher and Knox argue minutes before the Briton was slain in the apartment they shared.

He said he was at the house with Kercher when he fell ill and went to the bathroom with his iPod. He heard Knox and Kercher argue over money, then heard a "very loud scream" coming from Kercher's bedroom, and rushed to it. There, he said, he saw an unidentified man who tried to attack him. Backing into the hallway, Guede said he heard the man say, "Let's go. There's a black man in the house."

Knox initially told prosecutors that she was home the night of the murder and had to cover her ears against Kercher's screams while she was attacked by Diya "Patrick" Lumumba, a Congolese man who owned a bar where Knox often worked.

In the November 2007 ruling ordering Knox and Sollecito jailed, a judge cited that account, but noted that Knox's memories were confused since she had smoked hashish earlier in the day. Knox didn't explain why she didn't try to help Kercher, and subsequently changed her account.

Lumumba was freed after two weeks in prison for lack of evidence, and has sued Knox for defamation. Separately, prosecutors charged Knox with slander for falsely accusing him ? and that was the sole charge on which her conviction was upheld Monday.

"There is a heavy conviction for slander. Why did she accuse him? We don't know," Prosecutor Giuliano Mignini said Tuesday.

In her final appeal to the court on Monday, Knox said she had been "manipulated" during her police interrogation. She previously accused police of beating her ? a claim that landed her another indictment on slander charges, a case that remains open.

The DNA evidence used to place Knox and Sollecito at the scene of the crime during the first trial was determined to be unreliable by a court-ordered independent review during the appeal. But that wasn't the only testimony purportedly placing them at the scene.

In addition to Guede's testimony and Knox's own initial statement, a homeless man testified for the prosecution that he had seen Knox and Sollecito near the apartment the night Kercher was killed.

The defense insisted his testimony was unreliable, and the witness damaged his own credibility by admitting on the stand to being a heroin addict.

Knox changed her account of her whereabouts. She and Sollecito concurred they were at his apartment the night of the murder, though Sollecito said he wasn't sure if she spent the whole night with him. Knox maintained they had smoked hashish, watched the French film "Amelie" and made love.

Prosecutors also claimed the apartment was unnaturally cleaned of any traces of Knox's presence. The only fingerprint belonging to Knox was on glass, while many more traces were left by two other Italian flatmates and visitors, they said.

Mignini theorized that Knox "herself felt the need to eliminate the traces of her presence" at her home, and accused her and Sollecito of going so far as to stage a break-in at the apartment to make the murder look like a burglary gone bad.

The room of another flatmate had been ransacked and a window smashed with a rock on the night of the murder, but Mignini said evidence showed the window was "quite probably broken from the inside."

There remains no motive for the killing and questions even swirl about the murder weapon.

Prosecutors contend a kitchen knife found at Sollecito's house was the weapon because it matched wounds on Kercher's body and carried traces of Kercher's DNA on the blade and Knox's on the handle. However, the court-ordered review discredited the DNA evidence, saying there were glaring errors in evidence-collecting and that below-standard testing and possible contamination raised doubts over the DNA traces on the blade and on Kercher's bra clasp.

In addition, the defense cast doubt on the knife, questioning why Knox and Sollecito would return it to Sollecito's home if it had been used in the murder. They maintain the real weapon has yet to be found.

Knox's behavior in the hours after the killing raised eyebrows and continues to raise questions about why she would display such apparent disregard after her friend had been brutally murdered.

The American turned cartwheels and did splits at the police station as she waited to be questioned by police, according to investigators and Kercher's friends during the first trial. They said Knox sat on Sollecito's lap, making faces at him, crossing her eyes and sticking her tongue out, while giggling and kissing him.

A lingerie shop owner testified that he saw Knox and Sollecito kissing and hugging in his shop the day after Kercher's body was found. He said Knox bought a G-string and talked about having "hot sex" once the couple ? who had been dating just a week ? got home.

Knox explained her actions as the result of being someone who "tends to act a little silly" under stress.

For Knox's supporters, such behavior was evidence of her innocence and naivete: They were the actions of a girl educated in Catholic schools and who never knew real hardship or tragedy.

Prosecutors painted another portrait ? that of a sex-obsessed, heartless murderer whose first testimony concerned a pink rabbit-shaped vibrator found in the home she shared with Kercher. ("It was a joke," Knox told the court.)

Of all the questions the case presented, Knox's true character remained key. On Monday, speaking fluent Italian, she left the jury that would acquit her with her own assessment:

"I did not kill. I did not rape. I did not steal. I wasn't there," she said.

Whatever the arrangement that suits your family, it is important to split the responsibilities to help minimize caregiver burnout, but to also take into account the senior's wishes and needs first.

Thomas Alter: Hank Williams Jr. Needs to Be Fired

"We have notified Mr. Mendenhall that we are ending our business relationship."

That's the statement that Champion Sports released, firing Rashard Mendenhall after the Pittsburgh Steelers running back questioned the American celebration of Osama Bin Laden's death and the events of 9/11 last May. Once Mendenhall was dropped there was no uproar, no complaining. Mendenhall raised a controversial opinion and was released from his lucrative deal without question.

The truth is Hank Williams Jr. should have been banished from Monday Night Football years ago. I'm all for nostalgia, but all Williams brings to the table is a cowboy hat, a grungy beard and a strained voice that's had a little too much Jim Beam and Coke.

It's not country music that's the problem, Faith Hill's Sunday Night Football Intro is one of the best in sports. It's the glorification of a singer who's most famous song is titled, "If the South woulda won," in a league that's nearly 60 percent African-American. I'm sure the lyrics, "If they were proven guilty then they would swing quickly,/instead of writin' books and smiling on T.V." is exactly what Michael Vick wants to think about when he turns on Monday Night Football.

So when Williams made a complete buffoon of himself Monday morning on Fox and Friends, comparing President Obama to Hitler, it was disgusting but hardly surprising. What was arguably worse than his Hitler snark, or calling Obama and Vice President Biden "the three stooges,"(nice math by the way Hank, a real Mensa scholar this guy is), was Williams calling the President of the United States "the enemy." This incident symbolizes how utterly absurd partisan politics in this country has become.

To ESPN's credit, it jumped on the situation right away, almost immediately removing Williams' intro from Monday night's broadcast. The question is whether he will be fired permanently despite a conservative backlash. The majority of the 3,000 plus comments underneath the ESPN.com article of the story defend Williams's right to free speech.

Interestingly, these same commenters offered no such explanation when Mendenhall decided to speak his mind.

In 2003 ,these same internet message board lurkers organized a fatwa against the Dixie Chicks, a far more popular country group than Williams, after they said that they were embarrassed to be from the same state as George W. Bush. Will many of the country radio stations that dropped the Dixie Chicks after their comments do the same with Williams? I'm not holding my breath.

The political rhetoric in this country is officially out of control. Comparing the sitting U.S. president to arguably the most sadistic murderer in the history of the world is lunacy. Not only should Williams not be on our TV's every Monday, he should probably be spending his days with Nurse Ratched.

So to the Monday Night Football decision-makers in Bristol: You're already off to a good start, but for the sake of our football-obsessed country, please give Hank Williams Jr. a permanent pink slip.
