Question by C.B.: My brother has lower back arthritis. Medical malpractice? Can he file a lawsuit?
My brother is only 28 and he was fairly recently diagnosed with arthritis. According to medical records, they had previously found a slight abnormality in his spine but never notified him of it and they did not do any further tests. But, he had been complaining about lower back pain for a long time.
It?s not right because my brother has always been an active person (goes jogging, likes to play basketball) and now he can?t do those things and many of the other things he used to do. It?s not right! and he?s falling into an episode again because he?s aware that he will probably never be able to be like he was.
Can he sue the doctor/hospital for failing to notify him of it in time, and maybe preventing his increasingly deteriorating spine?

His spine would have deteriorated anyway, modifications to lifestyle are always difficult, suing is not the answer it is not malpractice they did not give him improper medication that would cause this it is his body doing this.
