Automotive News is reporting that Chrysler has failed to stop a clothing manufacturer from selling "Imported from Detroit" apparel on the grounds of trademark infringement. U.S. District Judge Arthur Tarnow ruled in favor of Pure Detroit, saying that the automaker's request failed to show that the manufacturer would suffer any irreparable harm by the apparel company's actions. The judge also pointed out that Chrysler doesn't actually have a trademark on the "Imported from Detroit" slogan. After Chrysler aired its ad for the company's 200 during this year's Super Bowl, Pure Detroit began churning out T-shirts. The automaker sued Moda Group in March, and Pure Detroit counter sued in April.

The clothing maker's suit argued that Chrysler doesn't hold a trademark on the phrase in part because of the fact that the slogan is geographical and somewhat misleading, as Chrysler is actually based in Auburn Hills and the 200 is assembled in Sterling Heights. Apparently Judge Tarnow agrees with Pure Detroit's assessment.

Asteroid 2011 MD, reached its closest point to Earth just after 1 p.m. EDT, when it crept within 7,500 miles of Earth before whipping away again like a slingshot.

An asteroid the size of a tour bus zipped by Earth today (June 27) in a flyby so close that the space rock was nearer to the planet than some satellites, giving skywatchers and astronomers a tantalizing target for photos.

The space rock, called asteroid 2011 MD, reached its closest point to Earth just after 1 p.m. EDT (1700 GMT), when it crept within 7,500 miles (12,000 km) of Earth before whipping away again like a slingshot. The asteroid was flying over the southern Atlantic Ocean, off the coast of Antarctica, at the time of its closest approach.

The asteroid was discovered just last week on June 22, but there was never any risk of it impacting Earth, NASA scientists said. Astronomers with the LINEAR near-Earth object survey in Socorro, N.M., made the find. [Video of asteroid 2011 MD]

The space rock is on the small side, with latest size estimates ranging from 16 to 66 feet (5 to 20 meters) wide.

That means asteroid 2011 MD would likely be too small to survive the fiery plunge through Earth's atmosphere, let alone reach the surface, NASA scientists said. Asteroids this size can be expected to buzz Earth with close shaves about once every six years, they added.

The asteroid's close brush with Earth sent it off on a new trajectory through the solar system. The space rock flew well below geosynchronous satellites, which orbit 22,236 miles (35,786 km) above Earth, but well above the 220-mile (354-km) altitude of the International Space Station.

There was little chance the asteroid would hit a satellite because of the vastness of space and relatively small number of satellites, experts said.

Skywatchers spot asteroid 2011 MD

Astronomers around the world kept a close watch on asteroid 2011 MD during its flyby with hopes of snagging images of the object. [Skywatcher photos of asteroid 2011 MD]

Amateur astronomer Efrain Morales Rivera of Aguadilla, Puerto Rico, spotted the asteroid today just hours before its closest approach. At that time, asteroid 2011 MD was a small and was extremely dim, making it an extra challenge to spot, said Rivera, who posted his photos on the website Spaceweather.com.

"But overall, [it was] well worth the grand effort and the weather held off for this moment too," Rivera told SPACE.com in an email. "Presently a tropical storm is upon us as I write this."

A team of three skywatchers with the Remanzacco Observatory in Italy used remote operated telescopes in Australia and New Mexico to catch views of the asteroid. Two of the skywatchers, Ernesto Guido and Giovanni Sostero, are based in Italy, while their colleague Nick Howes is in the UK.

One of the trio's images, taken with the Faulkes Telescope South in Siding Springs, Australia,show the asteroid in red, green and blue wavelengths, while another using the New Mexico instrument show the space rock as a streak of light on a starry background.

"It was quite amazing watching it on Faulkes literally fly across the screen," Howes told SPACE.com. "We had to move the telescope four times just to keep up."

Another photo of asteroid 2011 MD, this one snapped by astronomer Peter Birtwhistle of the Great Shefford Observatory in the United Kingdom on June 23, revealed the space rock as little more than a dim, moving point of light.

Don Yeomans, of NASA's Near-Earth Object Program Office at NASA's Jet Propulsion Laboratory in Pasadena Calif., told SPACE.com that astronomers hoped to take radar observations 2011 MD during the asteroid's flyby. However, hopes were low for any detailed images because of the space rock's small size, Yeomans added.[Photos: Asteroids in Deep Space]

Only seasoned skywatchers with medium-sized telescopes were expected to see the asteroid at all, NASA officials said.

When the asteroid was first discovered, the early reports suggested that it would make its closest approach to Earth on about 9:30 a.m. EDT (1330 GMT), more than three hours earlier than the actual event. But that report was based on just two days of observations, Yeomans said.

"The new improved orbit has 4 days of observations rather than two, and the current Earth close approach time is now 1:00 pm EDT on Monday," Yeomans said in an e-mail. "This time should be good to a few minutes."

Earth's asteroid close shaves

Asteroid 2011 MD is the second space rock to zip extremely close by Earth this year. The other object, called asteroid 2011 CQ1, passed within 3,400 miles (5,471 kilometers) of Earth on Feb. 4, making it the closest known flyby of an asteroid to date.

NASA scientists and other astronomers search for near-Earth space rocks like 2011 MD as part of a program to identify potentially hazardous asteroids that could threaten the planet.

MANAMA, Bahrain ? Bahrain's king says an independent commission will investigate allegations of rights violations during anti-government protests and a deadly crackdown in the Gulf kingdom.

Wednesday's announcement by King Hamad bin Isa Al Khalifa's comes ahead of government-designed reconciliation talks between Bahrain's Sunni rulers and the opposition.

Bahrain's Shiites are demanding greater freedoms and more rights in the island nation that hosts the U.S. Navy's 5th Fleet.

The king says Bahrain is committed to reform and respecting human rights, but he accuses the protesters of pushing the country into a "state of chaos" with street marches and sit-ins earlier this year.

The king made the comments during a televised speech.

MANAMA, Bahrain (AP) ? Bahrain's special security tribunal handling the appeals of 21 opposition leaders convicted of plotting against the state on Wednesday adjourned the hearing until September.

The postponement in the high-profile case comes just three days before Bahrain's Sunni rulers plan to open reconciliation talks with the opposition they crushed during a wave of Shiite-led demonstrations demanding greater freedoms earlier this year.

The security court's decision to adjourn the appeals hearing for the 21 prominent opposition figures has further eroded the appetite of the biggest Shiite party, Al Wefaq, to participate in the reconciliation talks, which are set to begin on Saturday.

The appeals hearing is now set for Sept. 11.

Washington has encouraged dialogue in the island nation, home to the U.S. Navy's 5th Fleet.

The U.S. has also urged Bahrain's Sunni monarchy to meet some the opposition's demands. Washington has also expressed concern about the severity of the sentences and the use of military-linked security courts against the protesters in the tiny kingdom.

But Washington has taken little action against Bahrain's monarchy for its harsh crackdown, which was backed up by a Saudi-led military force that came to the aid of Bahraini rulers in March when martial law was imposed to quell dissent.

At least 31 people have died since February when the country's Shiite majority ? inspired by uprisings elsewhere in the Middle East ? started a campaign for greater freedoms and an end to the Sunni hold on power.

Hundreds of Shiite opposition supporters and leaders have been arrested or dismissed from state jobs and universities.

The prosecution of opposition supporters after the emergency rule was lifted June 1 signals that the kingdom's Sunni rulers do not intend to end their relentless pursuit of dissidents, despite appeals for dialogue.

Bahrain's King Hamad bin Isa Al Khalifa's is expected to address the public later on Wednesday and outline the aim of the government-arranged dialogue.

Wefaq leaders say they will decide if they'll join the talks after hearing the king's speech. They have previously demanded that authorities roll back security measures and halt the trials against activists before talks begin.

So, perhaps it?s not the nicest thing to say, but?I?m not sure I believe in marriage anymore.

I mean, think about it:?For the past 60 years, 50% of marriages have ended in divorce.

So what?s the difference between that?(divorce)?and two people dating, then breaking up?

Well, for one,?If you?re married, I hear you get guilt-free sex.?But then, if you?re married.?And get divorced ? it?s a little more messy?than if you were just dating and then broke up.?I mean, there?s no guarantee it?ll be more or less emotionally painful.?But if you get divorced, it doesn?t just mess the two ex-partners up,
It messes up the children,?And the couple?s relationships with friends,?And oftentimes, job performance and church attendance drop significantly.

And too often, due in part to a divorce, women and children are thrown into poverty. Besides, one might argue, getting marriage can introduce all this (perhaps undue) pressure! I mean, it?s a hell of a commitment to say, ?I love you ?til death do us part [or, if you?re Mormon, forever].? That sort of long-term commitment takes, I guess, a lot of love and a lot of trust and a lot of, well, commitment. It?s a risk.?But it no doubt has its rewards.

Still, I keep thinking, if only the pressure weren?t there ? I mean, people lose A LOT of sleep worrying about this commitment, whether they?ll be able to keep it, or whether they?ll be able to keep on keeping it, or if their spouse will keep on trusting the other to keep it ? because you never know how life will go. And there are a lot of pretty, smart, competent, kind people out there.

So how can you say, ?There?s just ONE??

Anyways, aren?t we supposed to love EVERYBODY??How are we supposed to do that, if we?ve got to expend so much energy on loving just this one person extra-specially, and not worrying about it, or worrying that the other person?s worrying about it, or worrying that the continued commitment will make you lame or boring or stale or less you.?At the very least, we can all agree, it sounds like hard work.?And if marriage is so worth it, and already such hard work,?I would think it?d be nice if there were a little less social pressure.?A little less pressure on those who are thinking they at least right now (even though they?re getting up in years) would prefer for whatever reason not to get married.

A little less pressure on those already married thinking they might get a divorce.
A little less pressure on those considering getting married that they keep it forever. Or else!
A little less pressure on those wanting to get married, but perhaps wanting a partnership that looks a little bit maybe somewhat ?unorthodox.? (Again, assuming marriages are tough, intimate, totally-worth-it-but-so-engaging sorts of things, I would think it better if we left each couple to figure out what their marriage will look like for them than pressure them to make it look like ours, especially if ours isn?t doing so hot as it is.)

And, in light of that, I think it?d be in order to put a little less pressure on those maybe thinking about marriage but also thinking they might like getting a little intimate first with somebody special without yet worrying about the bonds and ties of the life-long commitment we commonly call marriage.?I mean, I?d be the first to admit, I LOVE weddings. They?re some of the happiest occasions life has to offer, and not just for the couple newly wed.?And I?m not saying I like divorce, nor that I like it when couples break commitments of any kind.?It?s sad, and painful, and can mess you up forever.?But it doesn?t have to.?And all I?m saying is, if we eased up the pressure a little bit, the marriages that do last, might last a little longer, and be a little happier.

And the marriages that don?t last??Well, it?s my hope the two ex-partners, rather than feel heartbroken, anxious, lonely AND socially condemned, they?d feel a little more loved. Because hey! No pressure, dude (or dudette). God?s got you covered.?He is, after all, Love. And Love never fails.

Andrew Cuomo signed the law authorizing same-sex marriage in New York late Friday night, the number of Americans who will be able to marry same-sex partners doubled. New York is the first state to legalize same sex marriage after a dry spell following Maine's repeal of its marriage law a year and a half ago. Maybe for lesbian and gay people, It Gets Better after all.

And they're not the only ones. To paraphrase the great gay songwriter Stephen Sondheim: Straight women, rise! As same-sex couples marry, things get better for us, too. Remember the scary (and since-discredited) stories about how a woman is more likely to be killed by a terrorist than to find a husband after she turns 40? Or the one about how suitors are fleeing from Maureen Dowd because they're afraid of her Pulitzer Prize? The poll showing evangelical women in patriarchal marriages are happier than Sarah Jessica Parker? Well, same-sex marriage shows that people can make long-term, loving, sexual bonds with each other even where neither is naturally inclined to tell the other what to do. Same-sex marriage represents the possibility that marriage can be an equal deal after all?or at least one where inequality is not locked in at birth. The conservatives are right: Same-sex marriage will change opposite-sex marriage. And it's a good thing, too.

The people fighting same-sex marriage know this. They've been fighting some variation of the battle against marriage equality?for women?probably since the early Christians argued for the equality of women's souls. In the Anglo-American common law system, laws called "coverture" eliminated women's civic personhood when they married men. Unequal marriage was portrayed as a bargain between naturally created opposites: Women did women's work at home, and men took care of their public role, making contracts for them and voting in their interests. Apparently unsatisfied with this "bargain," women pressed for equality, including marriage equality, ultimately giving rise to the suffrage movement in the 19^th century and feminism in the 20^th.

At each point along the road to women's equality, conservatives defended heterosexual marriage inequality on the grounds that women were naturally suited only for certain kinds of lives. At the height of the suffrage battle in 1873, the Supreme Court rejected feminist Myra Bradwell's plea to be allowed to practice law on the grounds that "the paramount destiny and mission of woman are to fulfill the noble and benign offices of wife and mother." In 2001, after the second wave of feminism broke, conservative scholar William Bennett wrote in his ominously titled The Broken Hearth: Reversing the Moral Collapse of the American Family: "In the past husbands and wives had well defined roles. Today, thanks to the social and sexual revolution of our time, definitions blur, and disappointed hopes can turn rapidly into hopes abandoned."

The naturalism argument has suffered somewhat from the fact that women have been living outside their natural boundaries for decades. So marriage-equality resisters have moved to a kind of happiness project?trying to show that women with traditional gender attitudes are happier than their counterparts in more socially egalitarian relationships. In his much-debated 2006 article "What's Love Got To Do With It? Equality, Equity, Commitment and Women's Marital Quality" (PDF), W. Bradford Wilcox, a sociologist at the University of Virginia and resident scholar at the Institute for American Values, argued that "women are not happier in marriages marked by egalitarian practices and beliefs." And it's their fault: "We suspect that higher expectations of intimacy and equality among women, especially more egalitarian-minded women, have led them to view their husbands' emotion work more critically; we also suspect that these expectations have increased marital conflict and?in turn?dampened men's marital emotion work." More church attendance, higher male earnings, and lower female expectations are instead the key to family happiness, Wilcox concludes.

Opponents of heterosexual equality may have been first alerted to the dangerous possibilities of same-sex marriage by a 1993 Hawaii court decision. Writing against same-sex marriage in the Washington Post in 1996, Bennett opined "Marriage is not an arbitrary construct; it is an 'honorable estate' based on the different, complementary nature of men and women" (italics mine). The members of Congress who drafted the federal law rejecting same-sex marriage, the Defense of Marriage Act, dropped Bennett's article right into the Congressional Record. Seventeen years later, when the time came for the defenders of California's same-sex marriage prohibition, Proposition 8, to produce an expert witness on the harm such unions might produce, up popped David Blankenhorn, founder and president of Brad Wilcox's scholarly home away from home, the Institute for American Values. Who knows what same-sex marriage might do to the rest of our marriages, Blankenhorn intoned. Who knows? It might even make them more equal.

Turnabout is fair play. As the arguments for heterosexual marriage inequality were used to fight same-sex marriage, so the success of same-sex marriage is a living refutation of the argument that marriage requires congenital natural inequality with women on the bottom. Even the campaign for same-sex marriage, consisting of a torrent of moving stories about the happy same-sex couples who want to get married, is a feminist windfall. Maybe marital equality and happiness aren't so incompatible after all.

SINGAPORE ? Oil prices fell to near $90 a barrel Monday in Asia as a stronger U.S. dollar made crude more expensive for investors with other currencies.

Benchmark oil for August delivery was down 74 cents to $90.42 a barrel at late afternoon Singapore time in electronic trading on the New York Mercantile Exchange. Crude rose 14 cents to settle at $91.16 on Friday.

In London, Brent crude for August delivery was down $1.97 to $103.15 a barrel on the ICE Futures exchange.

The euro fell to $1.4132 on Monday from $1.4188 late Friday as investors worried about Greece's debt crisis. Greek lawmakers will vote Wednesday on a euro 28 billion ($39.8 billion) austerity plan, and German Finance Minister Wolfgang Schaeuble warned Sunday that Greece will not receive its next tranche of international aid unless the plan is approved.

Crude fell last week after the International Energy Agency said it will make 60 million barrels available over a 30-day period, half of which will come from the U.S. Strategic Petroleum Reserve. Some analysts said the price decline could be temporary.

"We doubt the world's energy supply will be solved by such a paltry sum," energy consultant The Schork Group said in a report. "This move might assuage the market this summer, but it is by no means a long-term fix."

Traders will also be eyeing the latest data on U.S. personal income and spending scheduled to be released later Monday.

In other Nymex trading in July contracts, heating oil slid 2.3 cents to $2.73 a gallon while gasoline fell 2.7 cents at $2.74 a gallon. Natural gas futures dropped 3.9 cents at $4.19 per 1,000 cubic feet.

New research shows that adolescents and young adults with type 1 (juvenile) diabetes have thicker and stiffer carotid arteries, also known as atherosclerosis, a risk factor for heart attack and stroke in adults. This research is believed to be the first to examine whether type 1 diabetes has a measurable effect on carotid arteries in this age group.

The research is part of The SEARCH CVD Study, a collaborative effort between investigators at the Colorado School of Public Health and the Cincinnati Children?s Hospital Medical Center. Dana Dabelea, MD, PhD, an epidemiologist at the University of Colorado and principal investigator said ?We hope that the knowledge provided by the research study will translate into better quality of care and better quality of life for youth with type 1 diabetes and will reduce the burden of cardiovascular disease in this patient population.?

Elaine Urbina, MD, a cardiologist at Cincinnati Children?s Hospital Medical Center, will present the research at the meeting of the American Diabetes Association in San Diego on June 27. ?We have new tools for early identification of cardiac and arterial problems in people with type 1 diabetes,? says Dr. Urbina. ?This means we can intensify therapy to improve glycemic control and reduce cardiovascular risk factors, especially obesity, thereby improving cardiovascular outcomes in people with type 1 diabetes.

The researchers studied 162 people between the ages of 17 and 23. Seventy-eight percent had type 1 diabetes and the remainder were the control group. After adjusting for age, race, sex and lipids, people with type 1diabetes had both thicker and stiffer carotids than the control group.

SEARCH CVD (RO1DK078542) is funded by the National Institutes of Health and is an ancillary study of the SEARCH for Diabetes in Youth study, a multi-center study funded by the Centers for Disease Control and Prevention and the National Institute of Diabetes and Digestive and Kidney Diseases.

When annuity payments are paid for life they are known as ?Life Annuity? structured settlements. The term ?life? does not necessarily mean they will be paid throughout the Annuitant?s lifetime. Instead, ?life? refers to a specific number of years based on the Annuitant?s life expectancy.

This type of structured settlement is referred to as ?Period Certain.? Annuitants can designate a beneficiary to receive remaining payments if they die before the settlement is fully paid.

Lump sum structured settlements are often used when financial compensation is awarded to minor children. Funds are distributed at a later date in the form of lump sum cash. There are two types of lump sum structured settlements which include ?Lump Sum? and ?Life Contingent Lump Sum.? The first lets Annuitants establish a beneficiary to receive funds in the event of death, while the second does not offer designation of a beneficiary.

Life annuities are established when Annuitants are entitled to monthly payments for life. Two types of life annuities are available and include ?Life Only? and ?Joint Survivor.? The first does not allow designation of beneficiary, while the second pays a designated beneficiary for the remainder of their life.

Lastly, Temporary Life Annuities provide regular payments for a specific time period. The annuity ends when the Annuitant dies and there is no beneficiary provision.

Structured settlements must be orchestrated by a lawyer. Some states allow Annuitants to sell future annuities, but most prohibit this practice. It?s always best to obtain legal and tax counsel to ensure compliance and minimize taxation.

The whale's odyssey and the surprising appearance of the plankton indicates a migration of species through the Northwest Passage, a worrying sign of how global warming is affecting animals and plants in the oceans as well as on land.

"The implications are enormous. It's a threshold that has been crossed," said Philip C. Reid, of the Alister Hardy Foundation for Ocean Science in Plymouth, England.

"It's an indication of the speed of change that is taking place in our world in the present day because of climate change," he said in a telephone interview Friday.

Reid said the last time the world witnessed such a major incursion from the Pacific was 2 million years ago, which had "a huge impact on the North Atlantic," driving some species to extinction as the newcomers dominated the competition for food.

Reid's study of plankton and the research on the whale, co-authored by Aviad Scheinin of the Israel Marine Mammal Research and Assistance Center, are among nearly 300 scientific papers written over the last 13 years that are being synthesized and published this year by Project Clamer, a collaboration of 17 institutes on climate change and the oceans.

Changes in the oceans' chemistry and temperature could have implications for fisheries, as species migrate northward to cooler waters, said Katja Philippart, of the Royal Netherlands Institute of Sea Research who is coordinating the project funded by the European Union.

"We try to put the information on the table for people who have to make decisions. We don't say whether it's bad or good. We say there is a high potential for change," she said.

The Northwest Passage, the route through the frigid archipelago from Alaska across northern Canada, has been ice-free from one end to the other only twice in recorded history, in 1998 and 2007. But the ice pack is retreating farther and more frequently during the summers.

Plankton that had previously been found only in Atlantic sea bed cores from 800,000 years ago appeared in the Labrador Sea in 1999 ? and then in massive numbers in the Gulf of St. Lawrence two years later. Now it has established itself as far south as the New York coast, Reid said.

The highly endangered gray whale sighted off the Israeli coast in May 2010 belonged to a species that was hunted to extinction in the Atlantic by the mid-1700s. The same animal ? identified by unique markings on its fluke, or tail fin ? appeared off the Spanish coast 22 days later, and has not been reported seen since.

Though it was difficult to draw conclusions from one whale, the researchers said its presence in the Mediterranean "coincides with a shrinking of Arctic Sea ice due to climate change and suggests that climate change may allow gray whales to re-colonize the North Atlantic."

That may be good for the whales, but other aspects of the ice melt could be harmful to the oceans' biosystems, the scientists warn.

Plankton is normally the bottom of the marine food chain, but some are more nutritious than others. Plankton changes have been blamed for the collapse of some fish stocks and threats to fish-eating birds in the North Sea, the studies show.

The migration of a solitary whale and two species of plankton is not of much concern so far, Reid said. "It's the potential for further ones to come through if the Arctic opens. That's the key message."
